The act of murder could qualify, depending upon the elements it includes with any of the following degree of homicide. Therefore differentiating degrees of homicide sometimes become very tricky to tackle but after careful investigation it can be distinguished easily.
Degrees of Homicide.

- Second Degree of Murder
It requires the actor to have malice aforethought without premeditation and deliberation. In Second-Degree a person wantonly disregards for the victim's life and his/her desire to inflict serious bodily harm to the subject.
- Manslaughter
It is the unlawful homicide without malice but with negligence or recklessness, where a prudent person would know the fatal consequences of his/her act if the necessary care is not taken.
- Accidental Death
It may have intent without malice. accidental death is involuntary and negligent manslaughter where a killing occurs because of person's acts are negligent and without regard for the harm to be caused for others.
- Justifiable Homicide
It is homicide is when the killing of another person takes place in self-defense or in defense of others. The act must be proven unavoidable and justifiable in light of the perceived threat. police killing in self-defense takes place during the process of law enforcement.
