A crime may be
defined to be any act done in violation of those duties which an individual
owes to the community, and for the breach of which the law has provided that
the offender shall make satisfaction to the public. A crime or public offense
is an act committed or committed in violation of a law, and the offender in the result shall receive the deserving punishment as mentioned in the law. Punishments
varies from country to country and from society to society, somewhere there are
stricter punishments for the minor crimes, where there are tendencies among the
society to consider the crime as an ill of society which could only be eradicated
through curtailing the tendencies of crime from the criminal, in other words removing
the all available opportunities of crime commission from the reach of criminal,
- Death
- Imprisonment
- Fine
(Financial and as physical service to society)
- Removal
from office
- Disqualification
to hold and enjoy any office of honor, trust, or profit.
While many crimes have their origin in common law, most have been
created by statute, and, in many states, such have been codified.
Elements Of Crime
there are six elements that go to constitute a crime, the following are these
- Person
- Guilty
intentions or men's rea on the part of such a human being.
- Commission
of that intention (Actus Rea)
- The injury must be part of it whether physical, mental, or financial.
- Concurrence
(Between men's rea and actus rea)
- Causation
(of harm)
Further Explanation of Core 4 Elements of Crime
Person
- The first element requires is that the act must be committed by a human being.
The first essential of a crime is a human being who...
- must
be under a legal obligation to act in a particular manner, and should be a
fit subject for award of appropriate punishment.
Men’s Rea
The second important essential of a crime is men's rea or evil intent. There can be no crime of any nature without an evil mind. Every crime requires a mental element. Even in the strict or absolute liability, some mental element is required.
Actus Reus (Act or omission)
The actus reus (act or omission) is an essential element of a crime. In other words, some overt act or illegal omission must take place in pursuance of guilty intention. It is said that something in addition to a men's rea is required to produce criminal harm.
The actus reus is constituted by the event and not by the activity which caused that event.
The Injury to another Human being
The injury should be illegally caused by any person in body, mind, reputation, or property.
These elements are fundamental for any crime
investigation process, without these mentioned elements crime commission with
intent and its degree of crime or nature of crime would become difficult to investigate
and reach a conclusion of any case. Therefore, it’s imperative to ignore or give
less serious attitude to those elements.
