Definition of Crime and its elements





Crime is a breach of statutory duty. it is also known as an offence. When a person commits a crime then his liability is determined by the elements of the crime. Which include the intention to inflict harm to the supposed person (Mens Rea) And the Wrong Act or the harmful act by the offender (Actus Reus). Thus, when these two constitute together, a crime is performed. Many attempts have been made to define crime but it has not been possible to discover the most scientific definition workable in all cases. Whatever to different definitions it is clear that it is wrong committed by an individual in a society. The crime results in punishment, and a special procedure is followed by deciding the accused person's guilt.

In ordinary language, The term crime denotes an unlawful act punishable by a state. The term "Crime" does not, in modern Criminal Law, have any simple and universally accepted definition, though statutory definitions have been provided for certain purposes. The most popular view is that crime is a category created by law; in other words, something is a crime if declared as such by the relevant and applicable law. One proposed definition is that a crime of offence (or Criminal Offence) is an act harmful not only to some individual or individuals but also to a community, society or the state ("a Public Wrong"). Such acts are forbidden and punishable by law.
